1. BUY FROM HV CAREA binding purchase agreement with HV CARE has not been entered into until you have received an order confirmation from HV CARE.HV CARE does not store the order confirmation itself after it has been sent to the customer. 2. PRICESAll prices include 25% VAT and are in Danish kroner unless otherwise stated.The prices are only valid within the borders of Denmark, excluding the Faroe Islands and Greenland. SALES GENERALThe price stated at the time of ordering is the applicable ordering price.HV CARE reserves the right to charge an order fee of DKK 25.00 including VAT if the order is not made via HV CARE's website. An order will be deleted if it is not picked up within 4 business days of placing the order. Pick-up items are invoiced at the current price at the time of ordering, and the price does NOT change either in the event of a price decrease or increase. 4. SPECIALLY ABOUT STORE SALESStore sales: purchases made in our store at HV CARE Cykler og avhjylmiddelen, Struervej 107, 7500 HolstebroIn store sales, there is NO right of return, as you have the opportunity to examine the item before the transfer/transfer of risk occurs. The product must be returned in its original and unbroken packaging, as the product must subsequently be able to be sold as new. 5. DELIVERYReservations are made for sold-out items and delayed delivery times at HV CARE's wholesalers.6. CANCELLATIONSIf you wish to cancel or cancel an order that has already been placed, this should generally be done by sending an e-mail marked "Cancellation". This should include the order date and order number.If you have received an order confirmation by e-mail, this can be returned to the sender with the text "Cancellation!" inserted in the subject line. There is no option for prepayment, as the customer's legal position here is significantly worse than with other forms of payment. Payment method 'BY AGREEMENT' can only be used by companies and public institutions, and only if you have already reached a payment agreement with HV CARE. If you wish to make such an agreement, this can be done here for private companies and here for public companies. 8. RIGHT OF COMPLAINTA 2-year warranty is provided on products purchased from HV CARE. The difference between warranty and guarantee can be seen under Purchase Rules. If there is an additional warranty or guarantee, it will be stated separately on the invoice.Should the product unexpectedly break during the warranty period, it will be repaired free of charge at our or the manufacturer's workshop. Damage to the product caused by operating errors, handling errors, modifications or gross misuse by the user is not covered by the warranty. This also includes changing the power supply to any relevant component. 9. USE OF THE RIGHT TO COMPLAINTComplaints regarding errors and defects must be notified to HV CARE within a reasonable time after receipt of the goods.The customer is strongly encouraged to provide a statement regarding the product's error or defect in connection with the complaint, as failure to do so may result in an extension of the remediation process due to troubleshooting. Goods that are not covered by the right of complaint and/or are received without proper packaging will be repackaged and an amount corresponding to HV CARE's costs for necessary and proper packaging will be charged. Goods returned cash on delivery or sent without postage will be refused receipt by HV CARE. 10. RETURNED GOODS THAT DO NOT CONTAIN DEFECTSWhen returning defective or incorrect goods to HV CARE, where an error or defect, defined and stated by the customer, is not found, the goods will be returned to the customer including a testing fee.The test fee is 200 per half hour incl. VAT. The test fee is calculated based on time spent in connection with testing and troubleshooting. If accessories are included, the quantity and product description must be included. If accessories are included that are not immediately apparent on the RMA form (complaint form) included, HV CARE cannot be held responsible for any loss of these items. Goods should be returned with a copy of the invoice stating the time of purchase of the complained product, otherwise the goods will be put on hold until a copy of the invoice and any error message on the product are available. 11. PROTECTIVE RETURNAll products returned to HV CARE must be properly packaged.HV CARE recommends that the item be returned via parcel post with GLS. This way, it is possible to track the package and thus removes any doubt as to whether the item has been delivered to HV CARE. Furthermore, the customer has the option of being able to request the package if delivery has not taken place. 12. SPECIAL PROVISIONS FOR BUSINESSESThe same terms and conditions of sale apply as for consumers, however with the following modification:• There is no right of withdrawal for traders • There is a 1-year warranty period from the original invoice date. Replacement or repair does not trigger a new 1-year warranty period. • HV CARE reserves the right of ownership to goods purchased on credit until the full purchase price has been paid. o All costs associated with enforcing the retention of title are borne by the buyer. o Interest accrues from the due date at 1% per month commenced. RIGHT OF COMPLAINTThe right of complaint is the customer's right to complain about a product that has defects or deficiencies that were present when the product was sold. The customer has two years to find defects or deficiencies in the product that are demonstrably the seller's responsibility. The burden of proof lies with the retailer for the first 6 months, and the customer for the subsequent 1½ years. The right of complaint is the customer's statutory right.2. WARRANTYA warranty is a special agreement between the buyer and the seller. If the customer and the seller agree that there should be a two-year warranty for a product, the customer can complain about all types of defects and deficiencies during this period. In this case, it is the seller's responsibility to prove that the defect is due to a breach of contract on the part of the customer. A warranty is not the customer's statutory right.3. RIGHT OF EXCHANGEThe consumer can generally demand an exchange of a product instead of accepting the seller's offer to have the product repaired. This was the case until 1 January 2002. However, there is a very important caveat: The consumer can only demand an exchange if the demand does not impose disproportionate costs on the seller in relation to a repair.4. REASONABLE TIMEIn the new Danish Sales Act, the consumer always has two months to react after a fault or defect in a product is discovered. Complaints made within 2 months are therefore considered to be within a reasonable time and thus in accordance with the law. Complaints can be made later than two months and still be within a reasonable time, but this must be assumed to be a rarity.5. THE RULE OF PRESUMPTIONThe last significant change to the Danish Sales Act is the so-called presumption rule, which means that within the first six months after a purchase, it is presumed that the defect was present at the time of purchase. In practical terms, the rule means that consumers are guaranteed a lighter burden of proof within the first six months and means that the consumer has an easier time getting the product replaced within the first 6 months.RIGHT OF CANCELATION1. THE 14-DAY RIGHT OF WITHDRAWALIn consumer purchases where the order of goods is made via telephone or the Internet, the consumer has a 14-day right of withdrawal.The right of withdrawal runs from the time the product is handed over to the consumer. Should the purchase be cancelled within 14 days, we will refund the price of the product. In order to exercise the right of withdrawal, the goods must be delivered to GLS or another carrier no later than 14 days after receipt. The condition for exercising the right of withdrawal is that the goods are returned in substantially the same condition as when they were transferred. If the goods are not returned in substantially the same condition, the goods are estimated by HV CARE based on a possible sale value. With regard to software, the seal must be unbroken. When exercising the right of withdrawal, please return the item in ORIGINAL PACKAGING. Lack of ORIGINAL PACKAGING often results in a decrease in the sales value, which is why, based on an assessment made by HV CARE, you will be credited with a correspondingly smaller amount corresponding to the decrease. In the worst case, lack of ORIGINAL PACKAGING, etc. may result in the purchase not being able to be cancelled. When installing PC systems assembled according to the customer's wishes, there is no longer a right of withdrawal from the time the customer has given consent for the installation to begin. The costs of returning the goods are borne by the consumer. HV CARE will return the amount within 30 days in accordance with Section 12c of the Danish Consumer Contracts Act. 2. HOW TO RETURN THE PRODUCTThere are three ways you can return the item:They may refuse to receive the item from the postal service. o In this context, we ask you to inform the carrier that you can immediately return the goods to HV CARE. You can receive the goods from the carrier and subsequently, within 14 days, return the goods to HV CARE. o In this context, we ask you to enclose a copy of the invoice for the purchased goods as documentation that the returned goods were purchased from HV CARE. You can return the item to the store within 14 days. o The address is HV CARE Bicycles and aids The return address is as follows: HV CARE Bicycles and aids Struervej 107 7500 Holstebro Please mark the package "Right of withdrawal" and attach a copy of the purchase invoice as documentation that the returned item(s) was purchased from HV CARE. The amount will be returned by check issued to the person listed on the purchase invoice. Returns due to cancellation are at the buyer's own expense! HV CARE recommends that the item be returned via GLS parcel post. This way, it is possible to track the package and thus removes any doubt as to whether the item has been delivered to HV CARE. Furthermore, the customer has the option of being able to request the package if delivery has not taken place. Goods returned cash on delivery or sent without postage will be refused receipt by HV CARE. 3.
